Teleworking is regulated by Law 126 of February 18, 2020, which stipulates the following general guidelines:

  • Teleworking must be documented with an "Individual Teleworking Contract", which must comply with the same formalities of the regular employment contract established by the Labor Code.

  • The provision of the telecontracted service can be complete or partial, that is, the worker can work one day a week at the employer's facilities.

  • Work is formalized under the concept of "Guard", in which the worker is at the employer's disposal by calls or other means, to attend to emergencies or other eventualities.

  • An addendum must be made to the employment contract to modify teleworking in case the worker is already working in person.
