TELECOMMUTING
Teleworking is regulated by Law 126 of February 18, 2020, which stipulates the following general guidelines:
Teleworking must be documented with an "Individual Teleworking Contract", which must comply with the same formalities of the regular employment contract established by the Labor Code.
The provision of the telecontracted service can be complete or partial, that is, the worker can work one day a week at the employer's facilities.
Work is formalized under the concept of "Guard", in which the worker is at the employer's disposal by calls or other means, to attend to emergencies or other eventualities.
An addendum must be made to the employment contract to modify teleworking in case the worker is already working in person.
